Yes, I had this idea, too, but it doesn't solve the problem with existing mails. A problem is the language: If someone in Germany says that he didn't really understand the foreign language, courts are usually willing to believe him, and the agreement is void. The same is probably true for most countries where english is not the native language. Besides that, the person in question did already claim that he thought mails to the list were private. The chance that such a person would also claim that he didn't understand the foreign language text is high. That would leave the archive intact. There is still a chance that everyone who includes other peoples names or email address will have his post removed.
