Umm, since the guy committed copyright violation apparently, can't the original author "un-GPL" it? I mean, it was never legitimately GPLed, apparently. btw, there are a bunch of "real good" open source licenses.. at least supposedly. There's a list of open source licenses with the Good Housekeeping seal of approval, err, I mean, the Open Source Initiative stamp of approval.
